Melanifest is a digital fundraising platform that enables individuals and organizations to create campaigns, accept donations, and build community support for various causes and projects.

Our Services Include:

• Secure payment processing for donations

• Analytics and reporting capabilities
• Social sharing and marketing tools

To use our Service, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete information
• Comply with all applicable laws and regulations
• Not be prohibited from using the Service under North Carolina or federal law

Organizations must be legally established and in good standing in their jurisdiction of incorporation or formation.

Account Creation

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

• Enable two-factor authentication when available
• Notify us immediately of any unauthorized access

Account Verification

Payment Processing

All payments are processed through secure, third-party payment processors. We do not store your complete payment information on our servers.

Fees

• Platform fee: 2.9% + $0.30 per successful donation
• Payment processing fees as determined by our payment partners
• Additional fees may apply for international transactions

Refunds

Donations are generally non-refundable. Refund requests will be considered on a case-by-case basis and may be granted at our sole discretion for fraud, technical errors, or other exceptional circumstances.

Tax Implications

You are responsible for understanding and complying with tax implications of donations made or received. Consult with a tax professional for guidance.

Campaign Requirements

All campaigns must:

• Be for lawful purposes
• Contain accurate and truthful information
• Comply with applicable fundraising regulations
• Not violate any third-party rights
• Follow our community guidelines

Prohibited Campaigns

Campaigns may not be created for:

• Illegal activities or purposes
• Hate speech, discrimination, or harassment
• Political campaigns (subject to applicable election laws)
• Pyramid schemes or multi-level marketing
• Adult content or services
• Gambling or gaming activities
• Misleading or fraudulent purposes

Campaign Review

We reserve the right to review, approve, reject, or remove any campaign at our sole discretion. We may suspend or terminate campaigns that violate these Terms.

You agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Upload malicious code or viruses
• Collect user information without consent
• Spam or send unsolicited communications
• Circumvent security measures
• Create multiple accounts to evade restrictions

Our Rights

The Melanifest platform, including its design, functionality, and content, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your Content

You retain ownership of content you submit but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

• Disputes between campaign creators and donors

We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data or information
• Business interruption
• Emotional distress

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

Termination by You

You may terminate your account at any time by following the account deletion process in your settings. Active campaigns may need to be resolved before account closure.

Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Fail to pay applicable fees
• Remain inactive for extended periods

Effect of Termination

Upon termination, your access to the Service will cease, but these Terms will continue to apply to your prior use of the Service.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved in the state or federal courts located in North Carolina.

Dispute Resolution

We encourage you to contact us first at support@melanifest.com to resolve any disputes informally. For disputes that cannot be resolved informally, you agree to binding arbitration under the rules of the Arbitration Association.
